The Federal Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (45 C.F.R. Parts 160-164) ("HIPAA") set forth standards for protecting the privacy of individually identifiable health information. HIPAA´s requirements become effective as of April 14, 2003. Provider organizations are designated as "covered entities" relative to HIPAA law, while vendors such as TouchPointCare are designated as "business associates". It is incumbent upon providers to comply with HIPAA, and in doing so, will ask TouchPointCare to sign a business associate agreement to ensure consistent compliance with HIPAA regarding functions or activities on behalf of such Covered Entity that involves individually identifiable health information.
Patients or clients remain the responsibility of the provider organization.
